Nigeria: Edo State Power Regulatory Commission Assumes Control of Local Power Market from NERC

The Edo State Power Regulatory Commission (ESERC) is set to assume regulatory control of the state’s power market, taking over from the Nigerian Electricity Regulatory Commission (NERC). This transition is in line with the provisions of the revised Electricity Act 2023 and the updated Constitution of the Federal Republic of Nigeria (CFRN), according to a statement released by ESERC on Wednesday.

Under the Electricity Act 2023, NERC retains its authority over interstate and international power generation, transmission, supply, trading, and system operations. However, the Act also stipulates that any state intending to establish and regulate its intrastate energy market must formally notify NERC of its plans and request the transfer of regulatory authority to the state’s regulatory body.
