Former Kaduna State Governor, Nasir El-Rufai, has filed a ₦1 billion fundamental rights enforcement suit against the Independent Corrupt Practices and Other Related Offences Commission (ICPC) over the alleged unlawful invasion of his Abuja residence.

El-Rufai claims the search warrant used by ICPC was invalid, citing lack of specificity, material drafting errors, and absence of probable cause, violating his constitutional rights.

The suit, filed at the Federal High Court in Abuja, names ICPC, the Chief Magistrate of the FCT Magistrate’s Court, the Inspector-General of Police, and the Attorney-General of the Federation as respondents.

El-Rufai seeks declarations that the search warrant and subsequent search were unlawful, and any evidence obtained inadmissible.

He also seeks ₦1 billion in damages, broken down into ₦300 million for psychological trauma, ₦400 million as exemplary damages, and ₦300 million as aggravated damages.

Iyamu, SAN, argues the warrant’s defects contravene the Administration of Criminal Justice Act and constitutional protections.
