In a landmark ruling, Justice Olukayode Adeniyi of the Federal Capital Territory High Court Abuja has unequivocally awarded a substantial compensation of 100 million naira against the Federal Government of Nigeria.

This judgement, delivered in favour of the former Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, stems from the violation of his right to personal liberty.

The court went further to condemn the extended detention of Emefiele without trial, categorising it as a blatant infringement of his fundamental rights. 

Not only did the ruling acknowledge the severity of this transgression, but it also took a decisive step by restraining the Federal Government and its agents from re-arresting or detaining Emefiele without the explicit order of the court.

This groundbreaking legal decision was the culmination of a fundamental human rights suit initiated by the former CBN governor. 

His plea to the court sought not only justice but financial reparation, with Emefiele requesting a substantial N1 billion in damages. 

The court’s directive not only acknowledged the injustice suffered by Emefiele but also sought to prevent any recurrence of such violations by imposing specific restrictions on the government’s ability to arrest or detain him without proper legal authority.

The genesis of this legal battle traces back to June 10, 2023, when the Former CBN chief was arrested shortly after his suspension by President Bola Tinubu. 

The aftermath of this arrest has now paved the way for a landmark legal precedent, emphasising the importance of upholding individual rights and liberties even in the face of government actions.
