Kenya’s High Court Confirms Kithure Kindiki as Legitimate Deputy President

Kenya’s High Court has dismissed an application by former Deputy President Rigathi Gachagua seeking to overturn the swearing-in of his successor, Kithure Kindiki.

A three-judge bench comprising Justices Eric Ogola, Anthony Mrima, and Freda Mugambi ruled that events had overtaken the matter raised in the petition, citing a judgment by the Court of Appeal that makes Gachagua’s application futile.

The court also dismissed Gachagua’s petition to have the judges recuse themselves from the case, stating that the empanelment of the bench is an administrative duty of Chief Justice Martha Koome and her decision is final.

The ruling confirms Kithure Kindiki as Kenya’s legitimate Deputy President, following his swearing-in after Gachagua’s impeachment by Parliament.

Gachagua, who had abandoned his push to be reinstated into office, is now seeking compensation, including a monthly salary of KSh 1.2 million for five years and reinstatement of security and retirement benefits associated with the deputy president’s office.
