Nigeria: Court Dismisses Suit Challenging Rivers State Emergency Rule

The Federal High Court in Abuja has dismissed a suit challenging President Bola Tinubu’s proclamation of emergency rule in Rivers State, citing lack of legal standing by the plaintiffs.

Justice James Omotosho ruled that only the Supreme Court can determine such a case and that the plaintiffs, including Belema Briggs, did not suffer unique injuries or have the Attorney General’s approval to initiate the case.

The court also noted that the President’s claim of preventing a breakdown of law and order was undisputed, and allegations of breach of fundamental rights could not stand as the President acted under the appropriate Emergency Rule Order.

The emergency rule, declared in March and ended on September 17, aimed to restore security and prevent further disruptions in the state.
